1. Acceptance of Terms

By creating an account, accessing, or using PhysiqueCoach ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PhysiqueCoach ("we," "us," or "our").

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date above. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Description of Service

PhysiqueCoach is an AI-powered fitness coaching platform that provides personalized training guidance, nutrition suggestions, progress tracking, and body composition analysis. The Service uses artificial intelligence, including large language models, to generate coaching recommendations based on the information you provide.

The Service includes features such as AI-driven coaching conversations, daily check-ins, progress photo analysis, measurement tracking, workout and nutrition guidance, and data visualization. All features are provided on an "as is" basis and may be modified, updated, or discontinued at our discretion without prior notice.

4. Coaching Limitations

The AI coaching provided by PhysiqueCoach is generated by artificial intelligence and has inherent limitations. While we strive to provide helpful and accurate guidance, the AI may occasionally produce responses that are incorrect, incomplete, or not suitable for your specific circumstances.

The coaching recommendations are based on the information you provide and general fitness principles. The AI does not have the ability to physically assess your form, detect injuries, or account for medical conditions that you have not disclosed. You are solely responsible for evaluating the appropriateness of any recommendation for your individual situation.

PhysiqueCoach does not guarantee any specific results, including but not limited to weight loss, muscle gain, strength improvements, or changes in body composition. Individual results vary based on numerous factors including genetics, adherence, lifestyle, medical conditions, and other variables beyond our control.

6. User Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your information as described in our Privacy Policy.

You are responsible for the accuracy and completeness of the information you provide to the Service. You acknowledge that providing inaccurate health or fitness data may result in inappropriate coaching recommendations. You agree not to provide information about third parties without their consent.

You retain ownership of your personal data, including progress photos, measurements, and other content you submit to the Service. You grant us a limited, non-exclusive license to use this data solely for the purpose of providing and improving the Service. You may request deletion of your data at any time through the account settings or by contacting us.

7. Intellectual Property

All aspects of the Service, including but not limited to the software, AI models, coaching system architecture, system prompts, algorithms, user interface design, graphics, logos, trademarks, and all content generated by the Service, are the exclusive property of PhysiqueCoach or its licensors and are protected by applicable intellectual property laws.

The AI coaching system, including its prompt engineering, coaching methodologies, response generation logic, and behavioral design, constitutes proprietary trade secrets of PhysiqueCoach. You agree not to attempt to extract, reverse-engineer, reproduce, or derive the system prompts, coaching logic, or any underlying AI configuration used by the Service.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial fitness coaching purposes. This license does not include the right to modify, distribute, sell, lease, or create derivative works based on the Service or any portion thereof.

8. Prohibited Uses

You agree not to use the Service to:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code, AI logic, system prompts, or underlying algorithms of the Service.
• Use automated tools, bots, scrapers, or any other means to systematically extract data, coaching responses, or other content from the Service.
• Attempt to circumvent, disable, or interfere with any security features, rate limits, or access controls of the Service.
• Use the Service to build, train, or improve any competing product, AI model, or coaching service, whether directly or indirectly.
• Share, resell, sublicense, or redistribute access to your account or any coaching content generated by the Service for commercial purposes.
• Submit false, misleading, or fraudulent information to the Service, including impersonating another person.
• Use the Service in any manner that violates applicable local, state, national, or international law or regulation.
• Use the Service to harass, abuse, threaten, or harm others, or to promote violence, hatred, or discrimination.

We reserve the right to investigate and take appropriate action against any violations of this section, including immediate account termination and referral to law enforcement where applicable.

9. Account Termination

You may terminate your account at any time by using the account deletion feature in the Settings page or by contacting us at the email address below. Upon account termination, we will delete your personal data in accordance with our Privacy Policy and applicable data retention requirements.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, suspected fraudulent or abusive activity, prolonged inactivity, or if required by law.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, limitation of liability, indemnification, and governing law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHYSIQUECOACH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

Without limiting the foregoing, PhysiqueCoach shall not be liable for any injury, illness, or adverse health outcome resulting from following or relying on coaching recommendations provided by the Service. You acknowledge and agree that you use the Service and follow any coaching guidance entirely at your own risk.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you have paid to PhysiqueCoach in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction and venue of such courts.

Any dispute arising under these Terms that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in San Francisco, California. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
